Contract

By making a booking the client agrees to be bound by the conditions of this contract.

The contract is for a short-term holiday rental of the property specified on this site made between the client and the owners of Deugh an Chy (‘the owners’), Ann and Daniel Donovan, binding from such time that booking is made and inclusive of all the following conditions.

By making a booking the client contracts on behalf of himself/herself and all those in his/her party and represents that he/she has the authority to accept these conditions on behalf of and binding upon all guests in his/her party.

Bookings are accepted on the understanding that the property is taken for holiday purposes only and that, excepting babies, the number of people at the property is limited to that at the time of booking.

On booking the client is to make ‘the owners’ aware of the clients full name and address and telephone number and the name of each member of the clients party and the age of those under 18.

The client and any friends or family of the client visiting the property while the client is staying there must adhere to the conditions of the contract. 

Payment

A deposit of 25% of the cost is payable on booking if the booking is made more than eight weeks before the start of the rental. If a booking is made less than eight weeks before the Holiday is due to start, the full rent must be paid at the time of booking.

Bookings are provisional until a deposit is received and are held for 48 hours. The balance shall be payable eight weeks before the commencement of the rental. Non-payment of the balance of the rent on or after the due date may be construed as a cancellation of the contract by the client.

The owners shall not be responsible for sending reminders of the Due Date. 

Cancellation

In the event of a cancellation the total cost is payable.

Any cancellation made by the client for whatever reason shall be in writing and addressed to the address on this website. On receipt of the notice of cancellation we will seek to re-let the property for the period of booking. If a re-letting is achieved, we will refund money already paid by the client less rent for any part of the period which was not able to be re-let.

The client is strongly advised to take out holiday cancellation insurance.

Discounts

We offer a 10% discount to all tenants who have stayed with us previously and a 5% discount to anyone booking for 2 or more weeks. 

Only one discount may be applied to each booking.

Method of payment

Payments may be made by cheque, electronic bank transfer, postal order or cash. Cheques or postal orders should be made payable to ‘D P & A E Donovan' and can only be accepted up to two weeks prior to the holiday. Cash should always be sent by special delivery post. Post-dated cheques are not acceptable. Any charges raised against D P & A E Donovan by their bank for handling dishonoured cheques, bank transfers or any other payments will be passed on to the Guest who is liable to reimburse D P & A E Donovan within seven days of receipt of notification from D P & A E Donovan. 

Overseas bookings

Overseas guests may pay in Sterling by cheque drawn on a UK bank, or by international electronic transfer. Any charges for payments from overseas will be passed on to the Guest.

Period of Hire

Rentals are for a maximum of four weeks and commence at 5.00 pm on the day of arrival and terminate at 11.30am on the day of departure. 

Eligibility

Bookings will not be accepted from:
1.  people under the age of 18;
2.  all male or all female parties of more than four people.

Right of Entry

Whilst respecting the reasonable privacy of the client, the owners or their representative reserve the right to access the properties at all times, if necessary, for repairs and emergencies.

Client’s obligations

1 Care of the Property

The client shall take all reasonable and proper care of the property and its,equipment, furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair, condition, cleanliness and tidiness as at the commencement of the rental period.

2 Breakages or Damage

The client is required to inform the owner of any damage or breakage in or around the property promptly so that it can be repaired and replaced before the arrival of the next client.

The client is bound to reimburse the owners for replacement, repair or extra cleaning costs where reasonably demanded by the owners for damage caused by the client.

Should the owner be dissatisfied with the condition of the property upon the Guest's departure, they may refuse to take a booking from that client again.

3 Not to part with possession of the property

Not to sell or transfer the booking to another party.

4 Smoking

Smoking is not permitted anywhere inside the accommodation. 

5 Pets

One dog subject to prior arrangement with the owners and the following conditions.

Dogs are not permitted upstairs or on the furniture. Dogs must not be left unattended at the property at any time.

The client must clear up after the dog promptly.

The client is responsible for any damage howsoever caused by their dog and liable to reimburse the owner for any replacement or repair thereby necessitated. The owners reserve the right to terminate the contract if the behaviour of the client's dog is considered unacceptable.

Liability

The owners will not be liable for any act, neglect or default, for any accident, damage, loss, injury, expense or inconvenience, whether to person or property, which the client or any other person may suffer or incur arising out of, or in any way connected with the rental.

The owners of Deugh an Chy will not be liable for any loss or damage to any client's property or any property belonging to a member of the client's party howsoever caused.

The client or members of his/her party cannot hold the owners liable for any personal injury/death howsoever sustained where the owners and/or their employees have used reasonable skill and care; and/or where caused by the fault of the person(s) affected or any member(s) of their party (including inadequate supervision of children); and/or where caused by the fault of a third party, and/or where caused by an event that could not have been reasonably foreseen or avoided.

Web site descriptions

Some of the information on this Web site relates to matters beyond the property such as shops and public houses. Closure of such premises and other changes to external facilities are outside ‘the owners’ control.
